18 U.S.C. § 2257 Compliance Statement

This statement describes how ModelPlug LLC, a Nevada limited liability company ("ModelPlug," "we," "us," or "our"), approaches its obligations under 18 U.S.C. §§ 2257 and 2257A and 28 C.F.R. Part 75 — the federal record-keeping and labeling requirements for visual depictions of actual sexually explicit conduct. It should be read together with our Terms of Service, Content Removal Policy, Complaint Policy, and Privacy Policy.

1. Nature of the Service

ModelPlug is a software-as-a-service tool that lets adult-content creators organize their own content and publish, schedule, and manage it on third-party platforms that the creator independently owns and controls. ModelPlug does not operate a public content library, does not solicit or commission the creation of content, and does not itself film, photograph, or produce sexually explicit material. All content is uploaded by creators and distributed to the creators' own connected accounts.

2. Statement of Compliance

To the extent any visual depiction of actual sexually explicit conduct is uploaded to or transmitted through the Service, ModelPlug is committed to full compliance with 18 U.S.C. § 2257, § 2257A, and 28 C.F.R. Part 75. As a condition of using the Service, ModelPlug requires that every producer of such content has created and maintains the records those provisions require, and that every performer was at least eighteen (18) years of age at the time the content was created.

3. Producer Responsibility

Under 28 C.F.R. Part 75, the person who films, photographs, or otherwise creates a depiction is the primary producer and bears the primary record-keeping obligation. Each ModelPlug user represents, warrants, and agrees that, with respect to all content they upload:

• they are the producer of that content, or are fully authorized by the producer;
• every individual appearing in the content was at least 18 years old when it was produced;
• they have obtained and securely maintain government-issued photo identification and all records required by 18 U.S.C. § 2257 / 28 C.F.R. Part 75 for every performer; and
• they will produce those records to lawful authorities, and to ModelPlug where required, upon request.

Age and identity verification for creators is further supported by our third-party verification provider as described in our Privacy Policy.

4. Custodian of Records

For any records for which ModelPlug is a custodian, the Custodian of Records is:

Records are maintained at the above physical address and are available for inspection during regular business hours, Monday through Friday, 9:00 AM – 5:00 PM Pacific Time, in accordance with 28 C.F.R. § 75.4.

5. Cross-Reference and Indexing

Where ModelPlug maintains records, they are indexed and cross-referenced so that content can be located by (a) each performer's legal name, (b) any stage or alternative name used in the content, and (c) the content's internal identifier or URL — consistent with 28 C.F.R. § 75.2.

6. Exemptions

Certain material is not subject to § 2257 record-keeping, including content that does not depict actual sexually explicit conduct as defined in 18 U.S.C. § 2256(2), and matter for which ModelPlug acts solely as a transmission or distribution service and not as a producer. Nothing in this statement is an admission that ModelPlug is a producer of any specific content.

7. Zero Tolerance for Content Depicting Minors

ModelPlug maintains a zero-tolerance policy for any content depicting a minor. Any such content will be removed immediately, the responsible account will be terminated, and the matter will be reported to the National Center for Missing & Exploited Children (NCMEC) and appropriate law enforcement.
